Los hijos tienen derecho a la <strong>leg\u00edtima<\/strong> y, por lo tanto, no basta con excluirlos de la herencia para que pierdan este derecho. <\/p>\n<p class=\"isSelectedEnd\"><strong>El C\u00f3digo civil de Catalu\u00f1a <\/strong>establece las causas y los requisitos que se tienen que cumplir para poder desheretar un hijo.<\/p>\n<h2>Cu\u00e1les son las causas legales por desheretar un hijo?<\/h2>\n<p class=\"isSelectedEnd\">Entre las causas de <strong>desheredaci\u00f3n en Catalu\u00f1a<\/strong> que establece la normativa hay:<\/p>\n<ul data-spread=\"false\">\n<li>Las causas de indignidad establecidas legalmente<\/li>\n<li>La denegaci\u00f3n de alimentos al testador o a determinados familiares cuando exist\u00eda la obligaci\u00f3n legal de prestarlos.<\/li>\n<li>El maltrato grave al testador o a determinados miembros de su familia.<\/li>\n<li>La ausencia manifiesta y continuada de relaci\u00f3n familiar entre el testador y el hijo, siempre que sea <strong>exclusivamente imputable al hijo.<\/strong><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">Por lo tanto, la simple distanciaci\u00f3n entre padres e hijos <strong>no es suficiente por desheretar.<\/strong> Hace falta que se cumplan los requisitos previstos legalmente. <\/p>\n<h2>Qu\u00e9 dice la normativa catalana?<\/h2>\n<p class=\"isSelectedEnd\">La desheredaci\u00f3n est\u00e1 regulada por el<strong> Libro cuarto del C\u00f3digo civil de Catalu\u00f1a<\/strong>, relativo a las sucesiones.<\/p>\n<p class=\"isSelectedEnd\">Para que sea v\u00e1lido, se tiene que formalizar en <strong>testamento, codicilo o pacto sucesorio<\/strong>, indicar una causa legal de desheredaci\u00f3n e identificar el legitimario afectado.<\/p>\n<h2>Se puede impugnar una desheretaci\u00f3?<\/h2>\n<p class=\"isSelectedEnd\"><strong>Si.<\/strong> Un hijo desheredado puede impugnar la desheredaci\u00f3n si considera que la causa indicada no existe o no se puede acreditar.<\/p>\n<p class=\"isSelectedEnd\">Si el hijo niega la causa, corresponde al heredero <strong>probar que el motivo de desheredaci\u00f3n era real<\/strong>.
